General terms and conditions of Villa El Portet

1. RENTAL PERIOD
Tenant and landlord have an agreement about the rental period. The rental period begins on the day of arrival at 16:00 and ends on day of departure at 10:00.

2. RENTAL RATE

The rental rate depends on the booked period. In high season, only with a minimum of 1 week and the Saturday the arrival/departure day. In low season, different rates are agreed for a longer rental period (in the winter months).

Bed + Bath linen (1 large and 1 small towel and 1 beachtowel) à €17,= per person. This includes washing, ironing, compilation and collection of the bedding.

A mandatory final cleaning fee of € 185.- is not included in the price and must be paid in cash on day of departure to the manager.

Deposit of: €400,=. This amount will be refunded within 2 weeks if no damage has occurred.

Payment of the rental rate: 25% of the total amount must be made within 7 days after signment of the lease contract, then the reservation is final and the availability calendar is updated. The remaining 75% must be paid 6 weeks before arrival.

The rental price is the fee for the use of the house, including use of the fixed inventory, gas, water, electricity and wifi.
Tenant is strongly requested to deal efficiently with energy use, especially air conditioning. If electricity use is much higher than normal, the tenant hold the right to settle this with the deposit.

3. DEPOSIT
The landlord will after the end of the stay, refund the deposit within 14 days net to tenant which is due. Any damage should be reported immediately to lessor or manager. Tenant is liable for damages to the rented, including the damage to or loss of (part of) the inventory, caused during the rental period, unless tenant can justify that the damage to him, his family members or guests can not be held responsible. On the damage amount will be deducted the amount that is paid out under any insurance.

4. CANCELLATION
If for any reason the rented tenant on the agreed date cannot, want or will accept, he must immediately inform the landlord. A communication by phone must be confirmed in writing or by email.
If the tenant cancels the agreement for the period up to 6 weeks before the starting date of the rental period, he will be refunded 100% of the rent price, up to a maximum of the amount paid (to); in case of cancellation from 6 weeks until the start date of the rental period no refund will take place and should tenant use his cancellation insurance.

5. OTHER CONDITIONS
Landlord is required to make available the leased property on the agreed date and time in good condition to tenant. The Tenant must act as a good tenant and use the holiday home in accordance with these general terms and conditions. Smoking is NOT allowed in the entire house. Smoking is only allowed on terraces. Tenant should dispose household waste, bottles, paper, etc. in the appropriate containers nearby the villa at the Calle Puerto Espindola. Tenant must provide access for garden and pool maintenance. Persons concerned have their own key to the gate and will not enter the villa. Upon departure, the Tenant must leave the holiday home in a tidy state, that is to say, broom clean. The items present in the holiday home must be returned to their original location (as on arrival). Crockery / dishes must be washed and stored in it’s original place. The landlord is not liable for theft, injury, loss or damage of any kind, during or as a result of their stay in the house. The Tenant is liable for the damage and/or loss caused by him or his co-tenants to the holiday home or the items present therein. In case of improper use or leaving the house additional (cleaning) costs may be charged: Smoking indoors: € 100. No disposal of waste (including bathrooms), paper and glass: € 75. Not leaving the house broom-clean (also BBQ and oven): € 75. dishes not washed: € 50. Did not restore the existing items to the original location: € 50

Landlord can not be held liable for any damage or accidents that happen in or around the house.

The leased property may be occupied by not more than 10 persons, unless otherwise agreed with landlord. The tenant is not allowed in whole or in part, to rent out or give in use the leased property to others.

In the leased property are no pets allowed unless otherwise agreed with landlord.
